Mediation and Dispute Resolution

 

Dispute resolution techniques are varied and are not limited to the courts. Mediation, arbitration and other mechanisms are available to meet your needs more efficiently.

We believe that parties in a conflict benefit from exploring certain resolution techniques that can help settle a dispute more quickly and with fewer expenses and, above all, reach an acceptable agreement, both personally and commercially.

We offer different services to help you deal with disputes differently.

Mediation:

Mediation is a process by which the mediator, a neutral third party selected by the parties, helps them resolve their dispute. A master of the process, the mediator applies communication techniques that allow the parties to reestablish the dialogue, overcome deadlocks and negotiate an acceptable agreement that takes into account their needs and interests. As relationships are often at the heart of conflicts, mediation is particularly useful when maintaining a healthy personal or commercial relationship between parties is important or desirable.

Mediation is a confidential process. The mediator gives no opinion on the dispute or the nature of the agreement and does not render a decision. The mediation seeks the parties' empowerment and requires their active participation in the resolution of the conflict.

Mediation is not only for litigious situations. It can be very useful to overcome a deadlock or simply to help parties during the negotiation of a business agreement.

Marjolaine Gagnon practices in civil and commercial matters. Her main field of practice is mediation of intellectual property disputes, but she also intervenes in conflicts of diverse natures.

She is an accredited member of the Institut de médiation et d’arbitrage du Québec and of the Barreau du Québec in civil and commercial matters. She is also registered as a mediator with the Service de règlement des différends du Barreau du Québec and an accredited mediator for the Small Claims Division
